Across Canada, law on the sale of tissues varies widely. With the establishment of for-profit plasma banks in Saskatoon and Moncton, as well as calls to rescind federal prohibitions on the sale of sperm and eggs, new concerns about the expanding market in human tissues have recently emerged.
This presentation traces the history of exemptions on the sale of human tissues and fluids in Canadian law and public policy, focusing on blood, plasma, sperm, and eggs. Through this history, it reveals what the evolution of prohibitions on the sale of some tissues (and not others) can tell us about changing social values, and the contemporary commodification of the body.
